Acceptible Use policy
This Acceptable Use Policy document, including the following list of
Prohibited Activities, is an integral part of your Hosting Agreement
with ComputerMN.com. If you engage in any of the activities prohibited
by this AUP document ComputerMN.com may suspend or terminate your
account.
ComputerMN.com's Acceptable Use Policy (the
"Policy") for ComputerMN.com Services is designed to help protect
ComputerMN.com, ComputerMN.com's customers and the Internet community
in general from irresponsible or, in some cases, illegal activities.
The Policy is a non-exclusive list of the actions prohibited by
ComputerMN.com. ComputerMN.com reserves the right to modify the Policy
at any time, effective upon posting at
http://www.ComputerMN.com/aup.html.
Prohibited Uses of ComputerMN.com Systems and Services:
1.
Transmission, distribution or storage of any material in violation of
any applicable law or regulation is prohibited. This includes, without
limitation, material protected by copyright, trademark, trade secret or
other intellectual property right used without proper authorization,
and material that is obscene, defamatory, constitutes an illegal
threat, or violates export control laws.
2. Sending
Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of
Unsolicited Bulk Email through ComputerMN.com's servers is prohibited.
Likewise, the sending of UBE from another service provider advertizing
a web site, email address or utilizing any resource hosted on
ComputerMN.com's servers, is prohibited. ComputerMN.com accounts or
services may not be used to solicit customers from, or collect replies
to, messages sent from another Internet Service Provider where those
messages violate this Policy or that of the other provider.
The
sending of unsolicited commercial email (SPAM) through our web servers
promoting any web site, or via third party web servers promoting a web
site hosted by us, can result in the suspension or termination of the
client's web hosting account, without refund. A $50 clean up fee may be
charged for spam.
If ComputerMN.com suspects a client is sending
unsolicited commercial email (SPAM) through our web servers,
ComputerMN.com has the right to suspend or terminate their account with
or without notice
3. Running Unconfirmed Mailing Lists.
Subscribing email addresses to any mailing list without the express and
verifiable permission of the email address owner is prohibited. All
mailing lists run by ComputerMN.com customers must be Closed-loop
("Confirmed Opt-in"). The subscription confirmation message received
from each address owner must be kept on file for the duration of the
existence of the mailing list. Purchasing lists of email addresses from
3rd parties for mailing to from any ComputerMN.com-hosted domain, or
referencing any ComputerMN.com account, is prohibited.
4.
Advertising, transmitting, or otherwise making available any software,
program, product, or service that is designed to violate this AUP or
the AUP of any other Internet Service Provider, which includes, but is
not limited to, the facilitation of the means to send Unsolicited Bulk
Email, initiation of pinging, flooding, mail-bombing, denial of service
attacks.
5. Operating an account on behalf of, or in
connection with, or reselling any service to, persons or firms listed
in the Spamhaus Register of Known Spam Operations (ROKSO) database at
www.spamhaus.org.
6. Unauthorized attempts by a user to gain
access to any account or computer resource not belonging to that user
(e.g., "cracking").
7. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
8.
Unauthorized access, alteration, destruction, or any attempt thereof,
of any information of any ComputerMN.com customers or end-users by any
means or device.
9. Knowingly engage in any activities
designed to harass, or that will cause a denial-of-service (e.g.,
synchronized number sequence attacks) to any other user whether on the
ComputerMN.com network or on another provider's network.
10.
Using ComputerMN.com's Services to interfere with the use of the
ComputerMN.com network by other customers or authorized users.
11.
Offensive Content: You may not publish or transmit via Computer MN's
service any content that Computer MN reasonably believes:
· constitutes child pornography;
· constitutes pornography or adult related material;
· is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
·
is unfair or deceptive under the consumer protection laws of any
jurisdiction, including chain letters and pyramid schemes;
· is defamatory or violates a person’s privacy;
·
creates a risk to a person’s safety or health, creates a risk to public
safety or health, compromises national security, or interferes with a
investigation by law enforcement;
· improperly exposes trade secrets or other confidential or proprietary information of another person;
· is intended to assist others in defeating technical copyright protections;
· clearly infringes on another person’s trade or service mark, patent, or other property right;
·
promotes illegal drugs, violates export control laws, relates to
illegal gambling, or illegal arms trafficking;
· is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to Computer MN; or
· is otherwise malicious, fraudulent, or may result in retaliation against Computer MN by offended viewers.
Content
“published or transmitted” via Computer MN’s service includes Web
content, e-mail, bulletin board postings, chat, and any other type of
posting or transmission that relies on any Internet service provided by
Computer MN.
12. Internet Abuse: You may not engage in illegal, abusive, or irresponsible behavior, including:

Unauthorized access to or use of data, systems or networks, including
any attempt to probe, scan or test the vulnerability of a system or
network or to breach security or authentication measures (including
those belonging to Computer MN and its customers) without express
authorization of the owner of the system or network;
·
monitoring data or traffic on any network or system without the
authorization of the owner of the system or network;
·
Interference with service to any user, host or network including,
without limitation, mail bombing, flooding, deliberate attempts to
overload a system and broadcast attacks;
· Use
of an Internet account or computer without the owner’s authorization,
including, but not limited to Internet scanning (tricking other people
into releasing their passwords), password robbery, security hole
scanning, and port scanning;
· Forging of any
TCP-IP packet header or any part of the header information in an e-mail
or a newsgroup posting; or
· Any conduct that is likely to result in retaliation against the Computer MN’s network.
·
Use of Computer MN’s network in a way that unreasonably interferes with
Computer MN’s other customers use of the network
Customer Responsibility for Customer's Users
Each
ComputerMN.com customer is responsible for the activities of its users
and, by accepting service from ComputerMN.com, is agreeing to ensure
that its customers/representatives or end-users abide by this Policy.
Complaints about customers/representatives or end-users of an
ComputerMN.com customer will be forwarded to the ComputerMN.com
customer's postmaster for action. If violations of the ComputerMN.com
Acceptable Use Policy occur, ComputerMN.com reserves the right to
terminate services with or take action to stop the offending customer
from violating ComputerMN.com's AUP as ComputerMN.com deems
appropriate, without notice.
